The State

The law shall regulate its composition and operation. ARTICLE 57. Law may establish incentives and means to involve workers in the management of companies. ARTICLE 58. Private property and other rights acquired pursuant to the civil laws, which may not be unknown or violated by later laws are guaranteed. The property is a social function which involves obligations. As such, an ecological function is inherent. The State shall protect and promote solidarity and associative forms of property. By reasons of public utility or social interest defined by the legislature, shall be expropriation by judicial sentence and prior compensation. This is fixed by referring to the interests of the community and the affected party.

In cases to be determined by the legislator, that expropriation may advance by administrative authority, subject to subsequent contenciosa-administrativa action, including with regard to price. In the event of war and only to meet their requirements, the need for an expropriation may be decreed by the national Government without prior compensation. In the stated case, real property only may be temporarily occupied, to cater to the needs of the war, or to target their products to her. The State is always responsible for expropriations that the Government makes itself or through its agents. ARTICLE 60. According to the law, the State will promote access to the property.
